Specifications for Siding Repair

For those Homeowners who elect to use their own Contractor to complete siding repairs, the following specifications are enclosed. When the work is completed it must be approved and signed off on by Colin Devereux 570-956-7488. Colin is the BHHOA Inspector on this project. The cost is $50 to the Homeowner for the Inspection. The BHHOA recommends that you do not pay your contractor until the inspection is complete. If there the Homeowner does not get an inspection and their unit requires further repairs during the Siding Project; the additional repair work will be billed to the Homeowner at their expense.

Demolition of Siding

1. If needed to secure/repair siding, remove fascia boards and save for replacement

2. Removal of all damaged wood siding; full or partial board is acceptable.

3. Removal of existing felt vapor barrier. (if needed)

4. Remove any damaged dense foam insulation board. (if needed)

5. Inspect all exposed framework for water damage (notify community trust should any additional cost be incurred due to hidden defects) All damaged areas shall be photographed and submitted to the trust for approval. No payment for any additional cost and or repairs will be made without written approval from the community trust. (Unit # should appear in all photos.)

6. All waste disposal costs shall be incurred by the contractor.

7. While contractors are on the roof they shall use caution as to not damage roof shingles. Any damage shall be the responsibility of the contractor.

8. All work shall be limited to the cedar siding above the existing fascia boards.

Installation of Exterior Siding and Trim

1. Repair any framework damage that may be discovered as per line #5 of the Demolition of Siding

2. Re-Install dense foam board insulation.

3. Install 15# felt vapor barrier

4. Back prime or seal all siding before installation with approved product.

5. Install new siding as per industry standard practices.

6. Re-Install existing fascia or replace if damaged by removal. (Paint/Caulk as required)

7. Secure all ends of siding above fascia board on gable walls with (2) stainless screws (length as needed) and provide wood nailer between exterior wall studs as needed for attachment.

8. A final coat of approved sealer shall be applied to the exterior of replaced siding and trim.

9. Replace any damaged caulk joints above existing fascia boards.

10. All work shall be limited to the cedar siding above the existing fascia boards.


Material for Project

All materials shall be selected by the Trust with the advice of the Advisory Board as to maintain the existing cosmetics of the units. All materials shall be supplied by the successful contractor.

Warranty of Completed Work

As buildings are issued a certificate of completion, the date on the certificate shall be the start date of a one (1) year warranty. Work will be free from defects and conform to the requirements of the Contract Documents and standard construction practices. The Contractor shall be responsible for the cost of any materials to repair warranty claims. Any interior or exterior damage that would occur while under construction or a warranty claim during the warranty period shall be the responsibility of the contractor.

SEPTEMBER 9 2007 MEETING
President Tom Palangio called the meeting to order at 10:35 A.M.
There were 39 homeowners represented at this meeting

1. THE MINUTES OF THE PREVIOUS MEETING WERE APPROVED AS PRINTED.

2. THE TREASURER’S REPORT WAS APPROVED AS PRINTED.

3. TRUSTEE SEARCH COMMITTEE

a. Ed Vea reported that 30 banks have been contacted. Some want to manage our funds and appoint an on-site manager.
b. We did receive a proposal from Appletree. The Trustee Search Committee voted against this as it would be a conflict of interest.
c. Based on Legal Consul, we can assume the role of Trustee.
d. As of August 31, no checks have been written.
e. For us to move forward, we have to assume this roll.
f. We will have to write a new Trust Document. This will have to be approved by 2/3 of the Homeowners.
g. Our money will be staying at Mauch Chunk Bank and they will be paying our bills.
h. The Trust Document does not allow for an interim Trustee.
i. We will be getting a proposal from PMA to do some of the Trustee Duties.
j .Our Board and Advisory Committee will remain in place.
k. We will have to hire someone to do the Administrative Duties
l. Appletree will remain as our Property Management Company.
m. Insurance will remain in place.

Ted Kling made a motion to tally the votes. The motion passed

4. RENOVATIONS/STAINING PROJECT Mike Delancy/Keystone Concepts

a. Mike Delancy presented a repair proposal. He said the two bedroom houses would be $900.00 and the three
bedroom would be $1600.00. He said he knows that some houses would not need that many repairs.
b. He will be starting Units 7-10 soon. The houses will be power washed and then stained. The decks will be done in
two different colors to see which looks better.
c. He will do the repairs to the houses this fall.
d. Fawn Court will be the first court to be stained.
e. Homeowners will be responsible for the cost of the repairs.
f. Each homeowner will receive an estimate.
g. 90% of the work is around the gables and loose boards.
h. Every house will be inspected by Collin Devereaux. He will charge the homeowner $50.00 for the inspection.
i. If the homeowner does his own work, Mike will inspect the house before he starts the power washing and
staining.
j. The houses will be power washed then the stain will be applied.
k. The total project will be completed over the next four years.
l. Mike Delancy is the owner of Keystone Concepts which has offices in Blue Heron and Pittsburg.
m. Mike will do an assessment of the houses to try to determine which houses or courts should be done first.
n. It may be possible to borrow the monies needed to complete the whole job. We have done this in the past.


5 APPLETREE—BRAD JONES

a The bears are becoming active again.
b. Snow is on the way. If you want your upstairs deck shoveled, call Megan at Appletree. The cost is $30.00.
c. Metrocast was digging up some of the paths. They do not have to re-stone the paths If any one has a problem,
call Brad.
6. Homeowner Concerns for Appletree.
a. Rowland Hauser said the people who pick the garbage are not getting all the garbage out of the bottom of the
cans.
b. Could the maintenance people pick up the overflowing garbage?
c. There use to be hasps on the garbage cans. They were removed because the bears were still getting into the cans.
They were destroying the cans in the process. Appletree will get a quote on new Trash cans.
d. Are we going to be patching the roads any time soon?
e. The culverts need to marked better.

7. NEW BUSINESS
a. There were 84 valid votes. 75 were in favor of BHHOA becoming the new Trustee. 9 were opposed.
b. Ron Materniak has 101 E-mail addresses. If you have not given him your e-mail address, please forward it to him.
This saves time and money.
c. We have a Blog site. Anyone can look at it. . We encourage everyone to register for the site. It is a good way to
be informed as to what is going on in the community.
d. The Fall Fest will be held on October 13th at the Mountains Edge.
e. Rowland Hauser suggested that we give Linda Snyder a gift for all her years of service to the community.
Callie Price will look into this matter.
f. People who rent their houses now have to get an Occupancy Permit from Kidder Township. The houses have to
be inspected by the Code Officer and then brought up to code before the permit is issued. Maybe we should ask
to see the Code.
g. Holiday Decorating will take place on December 1, 2007.
h. Thank you to Jim Nanovic for attending this meeting. We will be retaining his services in the future.

Biologists go into dens to manage bear comeback

ILFORD, Pa.— Mark Ternent squeezes his bulky frame into the narrow opening of a bear den and shines a flashlight into the eyes of a 200-pound female.

Two black bear cubs are suckling, and their mother looks back at Ternent, alert but relaxed. It is early March, and these bears won't come out of hibernation for another six weeks.

The wildlife biologist shoots a tranquilizer dart into the mother's rump, but the dart goes into fat, not muscle, slowing absorption into her blood. Ternent waits 20 minutes, but she is still awake, so he shoots a second dart. This one does the trick — she's completely out of it.

Ternent then goes to work, dragging the bears from their den.

By the end of March, he will have visited some 30 bear dens around the state, tagging, weighing and taking the vital signs of hibernating mothers and their offspring as part of an effort to gauge the health and size of Pennsylvania's bruin population.

As caretaker of the state's 15,000 black bears, Ternent must figure out the optimal ratio of bears to people. That number will determine how many bears need to be killed by hunters to keep the population under control.

Bears are not a problem in more remote areas of the state. But here in the increasingly populous Pocono Mountains, complaints about nuisance bears are rising — especially among recent arrivals from New York, New Jersey and Philadelphia, who tend to have little experience with the animals.

"They see a bear in their backyard and they panic, thinking that the bears are going to take a couple of their children,'' says Tim Conway, an information and education supervisor with the Pennsylvania Game Commission.

Pennsylvania has had perhaps 20 bear attacks over the past 30 years, none of them fatal or even serious. But black bears have killed people in other states, and can inflict significant damage on crops and livestock.

Black bear encounters are rising in Pennsylvania and in many other Eastern states because the species is increasing in number at a time when more of their habitat is being lost to development.

It is such a topic of concern that bear biologists from around the eastern United States and Canada are meeting in West Virginia in April to discuss ways to manage conflict between bears and people.

"I think most states are becoming more aggressive in managing these populations, and it's a direct result of human-wildlife encounters,'' says Steve Williams, president of the Wildlife Management Institute and former director of the U.S. Fish and Wildlife Service.

He calls the Poconos and northern New Jersey, where bears have made a dramatic rebound, the "epicenter'' of black bear-human interaction.

In New Jersey, rising complaints about bears prompted officials in 2003 to allow black-bear hunting for the first time in more than three decades. But last year's hunt was canceled amid protests from anti-hunting groups, and New Jersey's top environmental official said non-lethal ways of dealing with bears need to be explored.

In Pennsylvania, hunting has long been used to control the bear population, which quadrupled in the 1980s and '90s. As a result of an extended rifle season and the introduction of an archery season, the number of bears killed through hunting has risen from 1,796 in 1996 to 3,122 in 2006.

Now Ternent, the bear biologist, is aiming to come up with a bear population objective for various parts of the state, taking into account factors such as human population density, forest cover and the availability of food.

Pennsylvania Game Commission workers pull a tranquilized black bear from her den.

Among other things, he wants to know how many cubs are out there, the ratio of males to females and the condition of the mothers. He will use the information to estimate the bear population.

Black bears sleep deeply when they are hibernating but wake up to give birth and tend to their young. They can be easily roused.

The den Ternent visited in early March is surrounded by houses, and you could walk past it and never know it was there. Only the sow's radio collar, put on her during a previous visit, betrays her location: a cavern formed by two large rocks.

After the bear is sedated, Ternent pulls her squawking, squirmy cubs from the den and hands them off to colleagues. Then he fastens a rope to the mother's front legs and they drag her out, too. For the cubs, born the first or second week of January, "this is the first daylight they've seen out of the den,'' Ternent says.

Their fur is remarkably soft, and they smell clean and fresh — much better than your typical family dog. They struggle mightily, but at only 6 pounds they are no match for the humans, who are careful to avoid the cubs' long, dagger-like claws.

Ternent and his team take the mother's vital signs — respiration, heart rate, temperature — fit her with a new radio collar, and tattoo her inner lip with a serial number that can be used to identify her if her ear tags come off.

She weighs 197 pounds, about 30 percent less than when she entered the den in November. But she has a soft, pillowy feel, her bones aren't sticking out anywhere and her fur is in good condition. She is in fine health.

It is the sow's first litter, and her cubs are weighed in plastic drawstring bags imprinted with Smokey Bear. Ternent tags them, then pushes and pulls their mother back into the den. He snuggles the cubs against their mother, covers the den's two entrances with pine branches, and departs.

"They are a charismatic species, no doubt about it,'' he says.

The "Homeowner Discount" Wallet Cards, that were distributed last year, will no longer be used.

SEASON PASS for 2007/2008 SEASON
If you want to purchase a season pass, they will still offer homeowners a 15% discount. I am not sure how you have to prove that you are a homeowner.

DAILY PASS DISCOUNTS
Still working out the details but she thinks....some type of VOUCHER will be provided through the homeowners association. She said that they would probably contact Trish in the rental office to get homeowner contact info. (this was not real clear and we'll have to follow up)
The concept is that the homeowners association would receive and SELL these vouchers (at some discounted price vs a walk up daily lift ticket) to homeowers and the homeowner would just present these vouchers at the ticket window, in exchange for a lift ticket.

I'll try to keep in touch regarding this issue...if anyone else has an update...please COMMENT on this article.

SEPT 9th HOMEOWNERS MEETING - "Unofficial" Quick Minutes

This is an "unofficial" quick summary of the Sept 9th BHHOA Meeting. The detailed meeting minutes will be published later this month.

TRUSTEE VOTE
We received a majority vote in favor of making BHHOA the Trustee. 75 YES votes and 9 NO. With BHHOA as the trustee, the homeowners will have the authority to make decisions through the existing BHHOA Board of Directors, Officers and Trust Advisory Board.
In the near term, Mauch Chunk Trust Co - will continue to hold our funds and Appletree will continue to be our property services provider.
Longer Term - there is no intention to have officers, board or volunteers do all the work of the former trustee. (like collecting funds, paying bills, keeping track of homeowners insurance etc.)
The officers and board will be meeting soon to discuss using Mauch Chunk Trust Co as our administrative services provider (collect fees, pay bills, etc), possibly hiring a property Manager, retaining Appletree for property services, and Jim Nanovic as our legal counsel. Others may be considered as well.

EXTERIOR REPAIRS and STAINING PROJECT
Quickly.....
We voted to have Mike Delancy's company do repairs, siding refurbishment and staining to Units 7,8,9,10 in the near future. (next few weeks) This will serve as our "test" set. Each homeowner (unit 7,8,9,10) will be given an estimate for their siding repair and be responsible to pay Mike Delancy directly. They can individually work with Mike if there are other special repair needs at the same time. The homeowners reserve will not pay for the REPAIR. The homeowners association reserve fund will pay for the finish refurbishment and staining of the 4 units, as well as all the other units in Blue Heron over time.
Next....
Mike Delancy's company has been chosen (after reviewing his experience, interest in doing the work, and competitive price) to do the siding REPAIRS on all the units that elected to use a trustee selected contractor. (He gave a high spot estimate of $900 to $1600 per unit for REPAIRS only) He will then inspect and estimate EACH unit to see if they will perhaps cost less to do the repairs. His work must meet the spec that we defined earlier. If there is undiscovered damage under siding, carpenter ants etc. the cost will be more. This work will be paid for by each individual homeowner and must be complete before siding finish work can be done. Realistically...we are hoping that Mike can perhaps complete over half the repairs before winter weather...and finish next spring. All homes (the homes Mike is doing, as well as the homeowners who do the work themselves or using another contractor) will be inspected by an independent inspector and "OK'd" before siding finish work can be started.
Next...
We will bid out the finish refurbishmennt and staining work. Estimates so far have ranged $600,000 plus for all 126 homes. (about $5,000/home) We only have $425,000 in our reserve fund....so we will likely have to spread this over 2 or more years. Concern was expressed that we should try to avoid spreading it over 4 years, as was earlier suggested and consider maybe 2 years. (perhaps the next two summers) Mike Delancy informed us that IF his crews can do REPAIR, Siding Refurbishment and Staining in each GROUP of units (units attached together) at the same time - there would be lower labor cost of moving ladders and crews around. We will discuss this option.

APPLETREE
Homeowners were generally pleased by the responsiveness of Appletree in some general grounds maintenance over the last month.
The Lake Club has also been improved this season.
The trash removal company will be contacted to remind them to completely empty cans (they have been leaving things in the bottom, which smell over time) IDEALLY, we want everyone to bag their trash before putting it into the cans.
They will also look into putting hasps onto the trash can lids again. (not LOCKS, just something to make it a little more difficult for bears and other animals to get into.)

SNOW SHOVELING PROGRAM FOR UPPER DECKS
If an individual homeowner wants to be put on Appletree's regular program to shovel their upper deck whenever the snow is over 12 inches...YOU must let Appletree know. The cost is $30 per occurance and will only be done at 12 inches or more. Contact Appletree at

BEARS FILLING UP FOR WINTER
There have been 3 to 4 bears spotted walking through Blue Heron and dumping trash cans over between 7pm and early am many days. Do NOT feed the bears and do not approach them. They are NOT tame like the deer. Usually they will stay away from humans as long as you don't surprise them. If the guard is made aware of it, they may drive around the courts with headlights on at night to chase them away. Just an FYI in case you see a vehicle driving around your court in the middle of the night.
Other neighborhoods are using hasps on their trash cans, which makes it slightly more difficult for bears to get food. If they find it easier to get food in Blue Heron....more will come around...this year and next. Humans can create a bear problem by making food accessible. Do NOT feed them.

FALL FEST
Reserve Saturday afternoon October 13th. We are now planning to have the picnic at Mountain's Edge lower level and patio. At this point, we do not believe we will be able to go to the top of Big Boulder via the chair lift, but we are still trying to work that out.

Background

Initial Meeting with Attorney Jim Nanovic.

The reason for forming the committee was at the suggestion of Jim Nanovic. He said it was doubtful that a Trustee could be found for the community given the current Trust Document, but that the community ought to perform due diligence by contacting banks in the area and soliciting them. The committee of people listed above was formed to conduct this work.

When the committee was formed at least three of the members where not apprised of the meeting or the details of the meeting with Jim Nanovic. They did not know that Jim had suggested that the outcome was not likely to be positive. In other words the committee diligently pursued and was always hopeful of finding an independent Trustee for the Community.

Furthermore, at least three members if not four did not know that the Trust Document permitted the Homeowners Association to be the Trustee. The mantra was always that this was not possible. It was only later when Wendy Ashby found the references in the Trust Document that identified the Homeowners Association as a potential candidate for the position that this option was even considered. In the meantime and even after this was known, the committee diligently pursued a separate independent Trustee as the best option.

Only when it became apparent that no independent organization was available or willing to take on the liability and financial responsibility of the Trustee, did the Committee consider and then decide to nominate the Homeowners Association for the role.

Trustee’s major duties and responsibilities include, but not limited to: operating and maintaining the Common Areas and Facilities; collecting and enforcing collection of common charges, assessments and other costs as deemed appropriate; negotiating and procuring services of contractors and managing agents; enforcing rules and regulations governing the use, maintenance and exterior appearance of houses and Common Areas; maintaining FDIC insured bank account and providing comprehensive investment management of our reserves; and exercising other critical powers as granted under the provision of current Trust Document.

And a Process was established and agreed to for handling the letters:

1) The letter that we are releasing now is only the initial offering to solicit all interested and qualified candidates within the banking community. I am going to incorporate Ed’s revision as provided in his e-mail earlier today. All others – please fax over your revisions to (718) 793-1692 or send a revised version via e-mail.

2) Only after we get responses from interested parties, we will then proceed with full disclosure of the Trust Document to those we choose. Hopefully, we can get at least several good candidates to choose from, though the Trust Document is very detailed and I foresee that some banks would not want to take on the full scope of the responsibilities outlined in the document for the price we can afford.

3) We, as a committee, would then prepare a detailed questionnaire for interviews with potential candidates. We would ask questions, such as “What other communities of homeowners in PA do you represent as a Trustee?”, “What practical steps can you incorporate into your operating procedures to ensure that homeowners’ interests are considered first and foremost?”, and other questions similar to those Wendy posted earlier today. This would be the time for us to brainstorm on the right number of relevant questions to get the ideal balance of trustee-homeowner relationships into place. I think that this is what we all want, a collective decision-making process that involves open communication and feedback between the Trustee and the homeowners.

4) If we are lucky and find such a candidate, it would save us time, and would allow us to get a “new sheriff” without taking extra steps (and resources) towards legal amendments to the existing Trust Document.

I going to distribute in a separate e-mail a scanned copy of the Trust Document, “hot off the press”, which actually came out nicely, considering the number of copies made from it over the last twenty years. Wendy, this will give you additional resources for your review.

And in the early part of May Letters were sent to the following banks and in many cases these individuals contacted directly by phone to discuss and promote the Blue Heron Community and the position of Trustee. The work was shared amongst all the Committee members, but Allys Futerman really did a Herculean effort in getting the letters authored, addressed and calling most of the banks.

Many banks asked for the Trust Document. Others declined right off the bat, saying that either they were too small or did not offer property management services. Subsequently all the banks declined.

On June the 1st.Wendy, having contacted a number of banks and also having a chance to review the Trustee Document made the following observations:

You may want to review the definition section of the trust document for the "trustee" definition. It defines trustee as First Eastern Bank, N.N., its successor or successors as Trustee hereunder and any homeowners or similarly association appointed by the owners of the Building Sites and Houses to perform functions similar to those of the Trustee.

To me this says, if the homeowners can agree to appoint a homeowner or group of homeowners to manage the property management company, collect the dues and hire a bank to hold the trust, things may be much simpler. The other local homeowner groups have already figured this out. We may even be able to save money and apply toward cost to update the siding.

[Based on the banks she talked to] It certainly is looking like the days of banks behaving as a trustee, as required by our Trust document are gone.


Throughout the Summer

The Committee met at least two times during the summer. We kept going back to a number of banks that did not close the door on us including Wayne Bank, Jim Thorpe Bank, Keystone National, and even Mauch Chunk. Wayne Wilga from Wayne bank (apparently he does not own the place  ) said they would like to work with us but that the Trust Document was too cumbersome, he had never seen one like it, and in any case some one else would have to do the property management and services. His response was typical.

In late July with the 30 day window for getting a Proxy out, Ed Vea called Jim Nanovic who confirmed that he thought we would not be successful in finding a Trustee until the document was changed. He confirmed that the Homeowners Association could be the Trustee and that this was our best solution for the time being. This information was shared with the individual members of the Committee who were not able to meet formally given the season.

Linda Snyder was on vacation during the last week in July, but eventually a meeting was held at Mauch Chunk on August 3rd where the Proxy was discussed and all agreed to recommend to the Homeowners that the BHHOA be appointed Trustee.


Other Potential Trustees / Options

Appletree was floated as a possible trustee but rejected based on the following reasoning and consensus:

If Appletree is the Trustee, it is not a good situation for them to also be the property management company. This is a clear conflict of interest since under the current Trust Document, they would have AUTHORITY to do everything. Form the advisory board, collect fees, make disbursements, hire contractors, set budgets, and judge the quality of the work performed to name just a few things. They nonetheless propose to be both Trustee and Property Services Company. There is no good argument for giving any entity this type of authority regardless of performance.

One other argument for making them Trustee that was rejected by the committee is that in that role they can help the Community rewrite the Trust Document. However, there is no reason that they have to be Trustee in order to offer advice; moreover they would then have undue influence on the process. The task of rewriting the Trust Document should be up to the Homeowners with the assistance of our attorney Jim Nanovic. Jim has experience with many communities in the local and a number of model Trust documents and ideas to review.

The BHHOA needs a majority (greater than 50%) vote this Sunday Sept 9th regarding the Trustee replacement.

Either:
1) Attend in person and vote at the meeting.
2) Vote by mail, by returning the letter you received from BHHOA.

GROUND RULES FOR BHHOA MEETINGS:

We have received complaints from homeowners regarding the climate created at June’s meeting by some homeowners. Therefore, in order to create a climate which is productive and professional, the Officers and Board of the BHHOA have adopted the following set rules for future meetings.

1) Homeowners recognized by the chair will be given 3 minutes to provide their comments on the topic currently being discussed on the floor. Once the 3 minutes has elapsed, the chair will recognize the next homeowner. Each owner will be recognized only once during a given topic.
2) EVERYONE in attendance is expected to conduct themselves in a professional manner. Respect for the each other’s opinion is paramount, and at no time will personal attacks be tolerated.
3) Due to time constraints, the time intervals assigned to each agenda item will be strictly enforced.

BACKGROUND INFORMATION - REPLACEMENT TRUSTEE VOTE

TO: All Blue Heron Homeowners

Background and Information for the upcoming BHHOA General Meeting

CURRENT TRUSTEE RESIGNS EFFECTIVE Aug 31, 2007
Linda Snyder, of Mauch Chunk Trust Company informed BHHOA, earlier in the year, that they were no longer interested in being our Trustee. The Trust company said that they could not cover their cost, for all the work that they did, and we suspect (like many banks) they were also not really interested in managing a property trust for 126 town homes and 40 acres of land. Bottom line - MCTC will no longer be our trustee after Aug 31.

The BHHOA funds will remain at Mauch Chunk Trust Co., earning interest and they are FDIC insured.

Under the current legal arrangement, the Trustee actually had the full AUTHORITY to manage our trust. They used an Advisory Board (consisting of BH homeowners) and reviewed major decisions with the Bank's Board of Trustees...but they had the legal authority. NOT BHHOA. BHHOA could change the Trustee with a majority vote.
That is why is was/is so important to pick a Trustee that we really trusted, with all that authority.

If you are interested in knowing what work the Trustee did....here is the list provided by Linda Snyder of MCTC:
Fielding Homeowners calls
Responding to vendors & suppliers
Keeping contact with Appletree Management Company and Blue Ridge Company
Process assessment payments as they come in.
Pay bills for the association on a weekly basis
Keep track of change of addresses, emails, and telephone numbers; and notify the corresponding secretary
Keep track of assessment payments
Keep track of insurance declarations
Send assessment notices at beginning of fiscal year. Also sending the series of notices if payments are not made; and send the semi annual notices out in November
Send the series of letters when not in receipt of insurance declaration pages
Buying insurance when necessary
Turning off water to unit(s) when lack of payment
Filing of property Lien when all efforts to collect fails
Prepare and process Resale Certificates
Prepare and process Prior Approval letters/requests
Send welcome letter out to new owners & notice to corresponding secretary
Prepare for the audit
Annually send out a copy of the audit to all homeowners
Prepare for the tax returns/ remit return and any tax due
Prepare the budget
Decide on the assessment
Prepare and keep track of the “Financial vs Budget” report
Remit estimate tax payments on a quarterly basis

Coordinate capital projects - roofing, painting etc.

SEARCH FOR A NEW TRUSTEE
A number of BH homeowners have volunteered MANY hours in this search effort.
30 banks have been contacted. Many responded, many said they are not interested. Other banks are still being interviewed. Some want to manage our funds and appoint an on-site manager.
Roy Miller informed us that it is becoming very rare to find a bank trust department willing to manage real estate.
When asked if there were any circumstances under which Mauch Chunk would stay on as
Trustee, Linda Snyder explained that it is a cost issue. At this time, Mauch Chunk is not making any money. With the liability and the work they do for our community, they would have to triple their fee.

The homeowners (search committee, some officers and board members) involved in this effort have utilized Jim Nanovic, a local attorney that represents many communities in the area, for advice throughout the process.

WHAT HAPPENS AUGUST 31?
After Aug 31, we have no legal trustee.
Our funds are still at MCTC.

WHAT NEXT ? SEPTEMBER 9th – 10:30am MEETING AT THE FIREHOUSE
The search committee, officers and board are suggesting that on Sept 9th, we vote to make "BHHOA" the legal trustee, with all trustee authority. There is no intention for BHHOA volunteers to take on all the administrative work of the previous trustee. Rather, BHHOA would likely hire several entities to perform the trustee administrative and property management duties. It could include entities like......
A Financial / Administrative Management Company - Mauch Chunk and another Management Company will provide a proposal.
A Law firm
A Property Management Company – might be Appletree or other
Possibly other Service providers – such as a general contractor to oversee capital projects

It requires a majority vote to make BHHOA (or someone else) the Trustee. Until we get a majority vote, or a vote by proxy, we have no Trustee and we are really stuck in limbo.


QUESTION/ANSWER
Some people have asked, why don't we just hire Appletree to be our trustee? They are willing to take on that role.

Dear Linda,

In an attempt to reduce the evident tension at our quarterly meetings with regards to the services provided by the Appletree Management Group (AMG), it was agreed with the Trustee at the homeowners meeting on June 2nd that (AMG) will supply with their invoice the timesheets and supporting documentation for each month’s work activities. The Trustee will review the materials for completeness prior to the issuance of the monthly installment payment.

Specifically the timesheets and supporting documentation for each month’s activities include:

• Timesheets for General Townhome and Common Area Maintenance providing name of individual providing the service the hours and description for each and every day work is performed and totaling no less than 40 hours in a week.

• Timesheets for Community Safety and Public Relations providing name of individual and or individuals providing the service the hours and description for each and every day the service is offered (in compliance with the contract) and not generally overlapping the daily work hours provided for General Maintenance above unless a special exception is noted and detailed.

• Timesheet for the Management Associate providing name of individual providing the service the hours and description for each and every day work is performed and totaling at least an average of 10 to 15 hours per a week for the month.

• In addition to the above generally provided information, AMG will provide detailed information relating to the scheduled activities for a given month as defined in Schedule C. For example for the month of June – cutting and trimming of lawn areas (four times) and application of vegetation control to stone areas. AMG will document how and when this is done and directly correspond the work to the attached timesheets; however, the timesheets without a separate report referencing the Schedule C activities alone will not constitute valid documentation of said work.

Thanks again for complying with this important request. The end result will be a more transparent view of the services provided and the means of their delivery. The hope is that such information will go a long way to improving the communities impression of AMG and the important services you provide.

BHHOA JUNE 2007 MEETING MINUTES

BLUE HERON HOMEOWNERS ASSOCIATION MINUTES
JUNE 3, 2007
Acting President Tom Palangio called the meeting to order at 10:40 A.M.
There were 20 homeowners present at this meeting

1. THE MINUTES OF THE PREVIOUS MEETING WERE APPROVED AS PRINTED.
2. THE TREASURER’S REPORT WAS APPROVED AS PRINTED.
3. TRUSTEE SEARCH COMMITTEE
a. Ed Vea reported that 30 banks have been contacted. Nine responded, saying they are not interested.
The other 21 banks are still being interviewed. Some want to manage our funds and appoint an on-site
manager. The Trust Document is very strict as written, but there are certain parts which can be loosened.
To change the Trust, we need two-thirds majority vote of all homeowners. We want to sit down with
potential Trustees and attempt to come up with a plan to work with them within our present Trust.
b. Roy Miller informed us that it is becoming very rare to find a bank willing to manage real estate.
c. Michael Leader asked if there were any circumstances under which Mauch Chunk would stay on as
Trustee. Linda Snyder explained that it is a cost issue. At this time, Mauch Chunk is not making any
money. With the liability and the work they do for our community, they would have to triple their fee.
d. Jim Nanovic, our attorney, told us that we have to stay with the Trust Document at this point.
e. We need to form a contingency plan in the event that we cannot find a Trustee by August 31, 2007.
4. RENOVATIONS/STAINING PROJECT
a. This past Tuesday (May 29) we interviewed an inspector, Collin Devereaux, for the upcoming renovation
project. His phone number is 570-956-7488. His fee is $6300.00 for the project. He will be on-call
before, during, and after the project and will make sure it is correctly finished before signing off.
b. This past Friday (June 1) a Pre-bid Meeting was held. Eleven contractors attended. All bids must be sent
to Linda Snyder.
c. Ted Kling stated that problems exist above the rake board. The estimates should have been for this area
only. If the contractors find more damage, they can inform the homeowners. Mr. Devereaux could then
advise the homeowner if more work is needed.
d. Linda Sndyer stated that the original plan called for all the needed repairs to be completed before
the staining project begins.
e. Ted Kling made a motion to have the sealed bids delivered to Linda’s office and opened by Linda, Collin
Devereaux, and Tom Palanigo. The motion passed.
f. Ted Kling, Tom Palangio, and Mike Delancey stained the pumping station with Behr stain, recommended
by Ted at the Mountain’s Edge Meeting. Behr guarantees this product for 8 years. We invite all home-
owners to look at the station and tell us what they think. The bid package for the entire staining project
has not yet been developed. Hopefully, a sample pack can be done later this summer so we can see how
it weathers the winter.
5. TRUSTEE’S REPORT – LINDA SNYDER
a. We have $26,274.70 in the Operating Fund.
b. We have $397,424.47 in the Reserve Fund.
c. Anyone hiring his or her own contractor for the siding repair needs to have the proper permits and inspection fees
paid to Kidder Township.
d. Two units had the water turned off for lack of payment.
e. One unit has no insurance record on file
f. The Trustee has signed the Appletree Contract for the next fiscal year.
g. We cut back on mulching this year to limit expenses.
h. We had to pay $16,000 to Blue Ridge Realty for Big Boulder Drive
i. Ted Kling stated that when Blue Ridge decides to pave Big Boulder Drive, we should also look into
repaving our courts in order to save us money.
j. The question was raised of how the recently-spent $20,000 from Reserve was split. Linda replied that it
it was spend on the Z&Z estimate and the removal of trees around the community by Drop Zone.
6. APPLETREE—BRAD JONES
a. Blue Ridge Realty completed sewer line repairs.
b. We are in the process of planting trees around units #10 and #11. Landscaping will be limited this year
due to budget restrictions as per the Trustee.
c. We are in communication with Blue Ridge about Big Boulder Drive. It is scheduled for re-paving
in five years. In two years they are to have the back road open for construction vehicles.
d. Locust Ridge does the street sweeping.
e. Ed Vea made a motion for Appletree to give us documentation to prove we are receiving the services
listed in the contract. The motion carried. Brad stated that the records would be turned over to the
Trustee, as the contract is with the Trustee.
f. Security does not possess the right to stop cars at the Gatehouse; Big Boulder Drive is the property
of Blue Ridge Realty, not the Blue Heron Community. Every homeowner should display vehicle tags
for security purposes.
g. Appltree will receive a proposal to install cameras at each court’s entrance.
h. One homeowner requested that security walk around the houses.
7. NEW BUSINESS
a. Ed Vea will be establishing a blog site for this association. Anyone can go to this site and post a comment,
suggestion, or topic for discussion. The URL is http://bhhoa.blogspot.com.
b. It was decided at the Board Meeting that all future minutes will be distributed via e-mail. Anyone not
having such an address will receive them in the mail.
c. Ed Vea and Frank Krause will be working on the Fall Festival. Volunteers are to contact Ed.
d. A few of the homeowners want to know when they will be getting the things that were promised
at the Lake Club.
e. Michael Leader protests the decision to eliminate the wood shed in front of houses #7 and #8.
f. The following are the detailed paint specs for the exterior colors used in the 2002-2003 painting of the
of the Blue Heron Community. ICI Paint/Stain

A FEW WORDS FROM OUR PRESIDENT

I personally would like to see a post from the new president of the BHHOA. Maybe he could share with us what is happening with the BHHOA.

NEW TRUSTEE???

Does anyone know where we stand yet on the selection of the new trustee? It is my understanding that a committee was selected to search out a new trustee. It is also my understanding that this has to be put to a vote with the homeowners for final approval. Could someone confirm or deny this info.

Meeting Minutes ????Where are you

It was discussed at many past meetings that the meeting minutes should put out shortly after the meeting is held instead of the usual week or 2 before the next meeting (which is 3 months after the meeting that the minutes pertain to). I believe it was actually brought to motion at one prior meeting and seconded. This would help to keep all homeowners ( especially those who were not able to attend the meeting current on the happenings of the BHHOA. To date, this practice has not been implemented. Could someone address this issue Thanks

Thanks to Ted and Tom for all their efforts to get this sample ready for us. I understand it took the better part of a day if not more to get it all done.

(Note: this stain has a polyurethane for ultraviolet light protection that gives the stain a little bit of a glean. This added protection is intended to extend the life of the product).

I'm embarrassed to admit I've never used (or even seen) a blog page before. Can somehow enlighten me on how to attach a photo?

Trish = you know something, your Blog Master, Ed Vea, has never done this before either. It seems that if everyone is to be able to post entries they have to be invited as authors.

So that is what I have done - I have sent out the Invites to each and everyone's email. When they respond I beleive they will be authorized to post... Let's see?

PS - Since I do not have email at Blue Heron, I will not be accepting invitations until I return to Philadelphia as late as Tuesday!

Welcome to the BHHOA Blog Page

As promised, we now have a blog page to help us all in managing our community. A blog like this one can be a wonderful tool for disseminating information, building consensus, and addressing community and in some cases individual concerns. But it also requires some restraint and discipline to keep it from becoming a free for all. For this reason I recommend that we all commit ourselves to good Blogetiquette. In other words when making an entry consider the audience, be concise, open to feedback and most importantly be respectful.

For the most part once an entry is made it will be left on the blog unless the author asks to have it removed or edited, a reasonable person might find it offensive, the matter has been addressed, and last but not least for reasonable editorial purposes (ie to make the blog more legible and informative).

Remember this is a community blog. Your comments and suggestions on how we can make it better are always welcome.

Again - welcome to our new blog. May it help us all manage and enjoy our community even more than we do now.
